Welcome to Swasth. These Terms of Service ("Terms") govern your access to and use of the Swasth mobile application, website, and related services (collectively, the "Service") operated by MyAdsMantra ("we", "our", or "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years of age and agree to these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Swasth is a health and wellness platform that provides:

• Personal health data tracking and management
• Medication reminders and tracking
• Appointment scheduling
• Telehealth consultation features
• Health insights and reports

The Service is available on Android and iOS platforms.

3. Important Medical Disclaimer

Swasth is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. The information and features provided through Swasth are for general informational and wellness purposes only.

• Always consult a qualified healthcare professional for medical advice
• Do not use Swasth data as a substitute for professional medical judgment
• In case of a medical emergency, call your local emergency number immediately
• We are not responsible for any decisions made based on data displayed in the app

4. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and authentication credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You may create an account using email, phone number, or third-party authentication (Google Sign-In, Apple Sign-In).

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools (bots, scrapers) to access the Service
• Share your account credentials with others
• Upload malicious content or code
• Impersonate any person or entity
• Use the Service to collect personal information of others without consent

6. Intellectual Property

The Service, including its design, code, content, trademarks, and all related intellectual property, is owned by MyAdsMantra and protected by applicable laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You retain ownership of any content you create or upload to the Service ("User Content"). By using the Service, you grant us a limited license to process your User Content as necessary to provide the Service.

7. In-App Purchases and Subscriptions

Some features of Swasth may require a paid subscription or in-app purchase. If applicable:

• Prices are displayed in your local currency and may vary by region
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage subscriptions through your app store account settings
• Refunds are handled in accordance with the applicable app store's refund policy
• We reserve the right to change pricing with reasonable advance notice

8. Third-Party Services

The Service integrates with third-party services including Google Sign-In, Apple Sign-In, Firebase, and Supabase. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any content, products, or services obtained through the Service will meet your expectations
• Any errors in the Service will be corrected

11. Limitation of Liability

To the maximum extent permitted by applicable law, MyAdsMantra and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, profits, or business opportunities
• Damages arising from health decisions made based on Service data
• Service interruptions or downtime
• Unauthorized access to your account or data

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MyAdsMantra and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting your account through the app settings or contacting support.

Upon termination, your right to use the Service ceases immediately. We will retain or delete your data in accordance with our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in India.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the Service or via email. Continued use after changes take effect constitutes acceptance. If you disagree with the changes, you should stop using the Service and delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
